Sexual Harassment Elimination Committee (SHE) and Internal Complaints (IC).
The Internal Complaints Cell (ICC) of C. B. Bhandari Jain College is established as per the guidelines of the University Grants Commission (UGC) and the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013. The College is committed to providing a safe, respectful, and inclusive environment for all students and staff members.
Purpose:
The ICC aims to:
- Prevent sexual harassment on campus
- Promote gender sensitivity and awareness
- Provide a secure and confidential platform for grievance redressal
- Ensure fair and timely inquiry of complaints
Scope
The Cell addresses complaints of sexual harassment involving students, teaching staff, non-teaching staff, and any individual associated with the College.
Structure of ICC:
The office bearers of ICC shall be functioning not more than 3 years. After the tenure a new body shall be elected. The ICC shall be containing the following designations:
1. One Proceeding officer (women, employed at a senior level)
2. At-least two members (who are committed to the cause of women and have had experience in social work or have legal knowledge.)
3. One member from NGO (which is associated for women welfare).
Functions:
The Internal Complaints Committee has two major functions:
- Preventive
- Remedial
Preventive:
- To work towards creating an atmosphere promoting equality, non-discrimination and gender sensitivity.
- To promote and facilitate measures to create a work environment that is free of sexual
harassment.
Remedial:
To receive and take cognizance of complaints made about sexual harassment at the university and give every complaint serious consideration. Crisis Management, Mediation and Counseling to conduct inquiries into the complaints, place findings and recommendations regarding penalties against the harasser.
Mission Statement
Objectives:
1. Prevention and Education:
- Develop and implement educational programs and workshops to raise awareness about sexual harassment.
- Promote a culture of respect through campaigns, seminars, and training sessions.
2. Policy Development and Implementation:
- Regularly review and update the college’s sexual harassment policies.
- Provide input on policy development and recommend changes to address emerging issues.
3. Confidential Reporting and Response:
- Establish confidential reporting mechanisms for victims of sexual harassment.
- Ensure prompt and fair investigations of reported incidents in accordance with college policies.
4. Support Services:
- Collaborate with counseling and support services to provide assistance to survivors of sexual harassment.
- Maintain a network of resources for affected individuals.
5. Advocacy and Outreach:
- Advocate for a harassment-free campus environment through collaborations with student organizations and community partners.
- Organize events and campaigns to promote awareness and engagement.
Committee Members:
- The Internal Complaints Committee comprises dedicated individuals from various departments within the college. Members include representatives from faculty, staff, students, and administrative units. The committee is diverse to ensure a broad perspective and inclusivity.
Confidentiality and Privacy:
- The committee is committed to maintaining the confidentiality and privacy of individuals involved in reported incidents. All information gathered during the investigative process is handled with the utmost sensitivity, and disclosure is limited to those directly involved in the resolution process.
Penalties:
- Formal warning, reprimand, or censure, withhold privileges of the student such as access to the library, auditorium, transportation, scholarships, allowances, identity card etc
- Suspend or restrict entry into the campus for a specific period.
- expel and strike off name from the rolls of the college, also including denial of readmission etc
- Award reformative punishments like mandatory counselling, performance of community services etc.
- Debar from representing the institution in activities or holding positions of responsibility.
- Withholding promotions, pay raises, or increments (for staff).
- o Transfer to another department or campus (for staff).
- Termination of employment or dismissal.
- Sexual harassment is illegal and may constitute a criminal offense, potentially leading to a police complaint and criminal prosecution.
- Punishments can include imprisonment (up to three years or more depending on the specific criminal charge), fines, or both, as defined by relevant laws like the Indian Penal Code or the Anti-Sexual Harassment Act.
Procedures/Mechanism for Lodging Complaint:
The committee has formulated the following procedure for lodging the complaints
- An aggrieved person is required to submit a written complaint to the Sexual Harassment committee within three months from the date of the incident. The committee members investigate the cases and act upon the cases which have been forwarded along with the necessary documents/proof, if any
- The committee assures that the grievance has been properly addressed to and redressed in the stipulated time limit.
